Terms of Service

1. Acceptance of Terms

By accessing or using the NovaSprite website (novasprite.tech), console, API, or any related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

2. Description of Service

NovaSprite provides an AI-powered platform for generating 2D game sprites, sprite sheets, and animations. The Service is currently in a pre-launch phase. Access will be granted progressively to users on our waitlist. We make no guarantees about uptime, output quality, or generation speed.

3. Eligibility

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Service. If you are using on behalf of a company, you warrant that you have authority to bind that entity.

4. Waitlist & Communications

By joining the waitlist, you agree to provide a valid email address.
We will use this email solely to notify you of your access to the Service or important launch updates.
You may unsubscribe from these communications at any time.

5. Acceptable Use

You may not:

Use the Service to generate illegal, harmful, or infringing content.
Reverse engineer, scrape, or attempt to extract our AI models.
Use the Service to train competing AI models.
Exceed rate limits or abuse API endpoints.

6. Intellectual Property

Your Inputs: You retain ownership of any text prompts or reference images you upload.
Generated Assets: We assign to you all right, title, and interest in the sprite images generated for you, subject to these Terms. However, we may use anonymized, non-identifiable outputs to improve our models.
Our Platform: All code, models, trademarks (NovaSprite™), and design are owned by us.

7. Pricing (Coming Soon)

There are currently no charges to join the waitlist or use any pre-launch features.
Pricing plans will be announced when the Service officially launches.

8. Beta/Early Access Provisions

The Service is provided “AS IS” without warranty of any kind. Features, APIs, and output quality may change without notice. We may discontinue the Early Access program at any time.

9. Termination

We may remove you from the waitlist or suspend your future access if you breach these Terms or if we discontinue the Service. You may request removal from the waitlist at any time.

10. Limitation of Liability

To the maximum extent permitted by law, NovaSprite and its founders are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the preceding 12 months.

11. Governing Law

These Terms shall be governed by the laws of India, without regard to conflict of laws principles.

12. Changes to Terms

We will post updated Terms on this page with a new “Last Updated” date. Continued use after changes constitutes acceptance.
